Agreement to Terms
By accessing or using the By Day web dashboard, mobile apps, or related services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our service.
Use of Service
Eligibility
You must be at least 13 years old to use By Day. If you are under 18, you must have parental or guardian consent to use the service.
Account Responsibilities
When you create an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
Acceptable Use
You agree not to:
- Use the service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service
- Upload malicious code or content
- Harass, abuse, or harm other users
- Scrape or extract data from the service
Community Content and Moderation
We have a zero-tolerance policy for objectionable content and abusive behavior. Objectionable content includes, without limitation, content that is unlawful, harassing, threatening, hateful, sexually explicit, violent, defamatory, or that promotes self-harm, illegal activity, or dangerous health practices.
When creating or responding to Creator plans in the marketplace, you agree to:
- Publish only plans, profile information, and qualified feedback you own or have the right to share
- Refrain from publishing objectionable content as defined above
- Refrain from making deceptive medical or health claims
- Treat other users with respect
We provide tools for you to moderate your experience:
- Report objectionable Creator plans from the marketplace
- Block creators to remove their plans from your marketplace experience
- Withdraw eligible plans and archive your own drafts through Creator Studio
We review reports of objectionable Creator plans and take action within 24 hours. Action may include removing the content, suspending or permanently ejecting the user from the service, and, where appropriate, reporting the user to law enforcement. Users who repeatedly violate these rules may have their accounts terminated without notice or refund.
Health Disclaimer
Important: By Day is a wellness and habit tracking tool, not a medical device or healthcare service. The service does not provide medical advice, diagnosis, or treatment.
- Consult qualified healthcare professionals for medical advice
- Do not rely on the app for emergency medical situations
- The app's recommendations are general wellness suggestions, not personalized medical guidance
- Results and outcomes may vary between individuals
Intellectual Property
The By Day service, including its original content, features, and functionality, is owned by By Day and protected by international copyright, trademark, and other intellectual property laws.
User Content
You retain ownership of any content you create in the service (notes, custom goals, etc.). By using the service, you grant us a license to use this content solely to provide and improve the service.
Connected Health Integrations
By Day's integrations with Apple Health, Google Health, Health Connect, and Oura are optional and require your explicit permission. We access only the health data categories you authorize. You can revoke device permissions, remove Google Account access, or disconnect a source from By Day at any time.
Subscriptions and In-App Purchases
Web Subscriptions
Subscriptions purchased on the By Day web dashboard are billed through our web payment processor. Billing, plan changes, and cancellation are handled in your By Day account settings on web.
iOS In-App Purchases
Subscriptions purchased through the By Day iOS app are billed through your Apple ID on the following terms:
- Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual, as selected at purchase) unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Billing: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the price displayed at the time of purchase.
- Managing your subscription: You can manage and cancel your subscription by going to your Apple ID account settings on your device (Settings > Apple ID > Subscriptions) after purchase. Deleting the app does not cancel your subscription.
- Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- Refunds: Refunds for iOS purchases are handled by Apple and are subject to Apple's refund policies. Contact Apple Support to request a refund.
The terms of use for iOS in-app purchases are governed by Apple's Standard End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, and are applied to By Day in addition to these Terms.
Service Availability
We strive to maintain high service availability, but we cannot guarantee uninterrupted access. The service may be temporarily unavailable due to:
- Maintenance and updates
- Technical issues or outages
- Circumstances beyond our control
Limitation of Liability
To the maximum extent permitted by law, By Day shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.
Changes to Service
We reserve the right to modify or discontinue the service at any time, with or without notice. We will not be liable if we choose to modify, suspend, or discontinue the service.
Termination
We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the service will cease immediately.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which By Day operates, without regard to conflict of law provisions.
Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes through the service or via email. Continued use after changes constitutes acceptance of the new terms.
