By accessing or using the by-day mobile application, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our service.
Use of Service
Eligibility
You must be at least 13 years old to use by-day. If you are under 18, you must have parental or guardian consent to use the service.
Account Responsibilities
When you create an account, you agree to:

Health Disclaimer
Important: by-day is a wellness and habit tracking tool, not a medical device or healthcare service. The app does not provide medical advice, diagnosis, or treatment.

- Do not rely on the app for emergency medical situations
- The app's recommendations are general wellness suggestions, not personalized medical guidance
- Results and outcomes may vary between individuals
Intellectual Property
The by-day app, including its original content, features, and functionality, is owned by by-day and protected by international copyright, trademark, and other intellectual property laws.
User Content
You retain ownership of any content you create in the app (notes, custom goals, etc.). By using the service, you grant us a license to use this content solely to provide and improve the service.
Apple Health Integration
by-day's integration with Apple Health is optional and requires your explicit permission. We access only the health data categories you authorize. You can revoke these permissions at any time through your device's Health app settings.
In-App Purchases
If you purchase premium features or subscriptions through the App Store, those transactions are governed by Apple's Terms of Service. All sales are final and refunds are subject to Apple's refund policy.
Service Availability
We strive to maintain high service availability, but we cannot guarantee uninterrupted access. The service may be temporarily unavailable due to:
- Maintenance and updates
- Technical issues or outages
- Circumstances beyond our control
Limitation of Liability
To the maximum extent permitted by law, by-day shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.
Changes to Service

Termination
We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the service will cease immediately.

Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes through the app or via email. Continued use after changes constitutes acceptance of the new terms.
